Family Law - International Custody Victory

Family Law

Family lawyer with mother after winning custody case in Dubai
Amount Involved: N/A

The Problem

A mother came to us after her ex-husband had taken their two children (ages 6 and 8) to his home country without her consent, violating a Dubai custody order. The case involved three jurisdictions - UAE, the father home country, and the mother country of citizenship. The father had filed for custody in his home country and was refusing to return the children to Dubai.

What We Did

Our family law team immediately filed a Hague Convention application for the return of wrongfully removed children. We coordinated with lawyers in the father home country to challenge his custody petition. In Dubai, we obtained an emergency custody order and travel ban against the father. We gathered extensive evidence demonstrating that Dubai was the children habitual residence and that the mother was the primary caregiver. We also arranged for child psychologist reports supporting the children best interests in remaining with their mother.

The Result

The foreign court dismissed the father custody petition and ordered the immediate return of the children to Dubai under the Hague Convention. The Dubai Personal Status Court then granted full custody to the mother with supervised visitation rights for the father. The children were reunited with their mother within 4 months of engaging our firm. The case set a precedent for cross-border custody enforcement in the region.

Final Outcome: Full Custody Awarded
